The Iowa Court of Appeals has ruled against a man who fathered a child with a woman who later married another man.
The court Wednesday upheld a Fayette County court's decision, nullifying a Buchanan County ruling that Dieter Erdelt of Oelwein was the biological father and granting him visitation rights.
Erdelt appealed, but the appeals court rejected his arguments.
The case involves a girl born in 2004 to Edna Helmuth.
Court records show Helmuth had a relationship with Erdelt. When she realized she was pregnant, she told her fiance, Samuel Schrock, and they were married in December 2003. Schrock's name was listed on the child's birth certificate as the legal father.
Erdelt filed a lawsuit seeking visitation and parental rights. He says he'll appeal.
